HIPAA Compliance for Branding Photography


As a former massage therapist, HIPAA compliance was ingrained in my training from day one. Now, as a branding photographer working with health and wellness businesses in Washington state, it’s still something I hold with great care. I’m constantly mindful of how we balance authenticity and visibility while staying fully within HIPAA regulations. It can feel like a fine line, but it is possible to show up confidently and compliantly.


How do we stay HIPAA compliant during a branding photoshoot?


First, it’s important to understand what information can never be visible in photos, including:

  • Names
  • Addresses
  • Dates or places of birth
  • Social Security numbers
  • Blood type
  • Treatment or injury information
  • Descriptions of distinguishing physical characteristics


If showing a screen, chart, or system is important to telling the story of your business, we have two compliant options:

1.Create a fake chart (for example, “John Smith” or “Jane Doe”) within your system.

  • This option requires pre-planning and setup prior to your photoshoot.

2.Use your own real charts, and I will carefully edit out and permanently delete any visible identifying information.

  • This option requires no extra work on your end.


When might client charts appear in branding photos?

Examples include:

  • A chiropractor, doctor, dentist, or physical therapist reviewing X-rays with a client and discussing a plan of care.
  • A dietitian, nutritionist, or naturopath reviewing bloodwork or test results using charts or graphs.

All of this can be photographed safely and intentionally with HIPAA compliance in mind.


What about showing “clients” in photos?

When someone appears in your branding photos as a client, a model release is always required. If minors are involved, a parent or legal guardian will sign a minor model consent form. I provide all necessary paperwork, and we will both retain copies.


How do you source client models?

There are a few options:

  • Real clients from your ideal target market who are dependable and aligned.
  • Friends, family, or community members : with some thoughtful boundaries.
  • If a sibling looks very similar to you, I recommend avoiding that option.
  • If your partner or spouse is not your ideal client, we’ll skip them as well.
  • I can source ideal client models for you.
  • This option is available for an additional fee.


Compensation considerations

If the model is a close friend, they may be happy to support your business simply as a gesture of encouragement or perhaps celebrated with lunch or dinner afterward. If the model is a current client or someone providing their time and presence, monetary or gift compensation is a thoughtful and respectful thank-you. Compensation arrangements are handled directly between you and the model.


For every client model, I provide a custom PDF outlining outfit guidance, arrival details, and what to expect during their portion of the photoshoot.


Why include clients in your health or wellness branding photos?

Including clients helps:

  • Potential clients immediately see who you work with
  • Showcase authentic, real life interactions
  • Put visitors at ease before they ever walk through your door
  • Demonstrate your services in a clear, approachable way


What types of photos will client models be part of?

A helpful way to think about this is to walk through your space as your client would. Where do they go? Who do they interact with? What services do they receive?

We can photograph every client touchpoint, including:

  • Opening the door and being greeted
  • Checking in at the front desk
  • Filling out paperwork
  • Sitting in the lobby
  • Walking down the hall
  • Reviewing charts with the practitioner
  • Receiving services
  • Being offered aftercare items like supplements

The goal is to visually guide future clients through the full experience and removing fear, building trust, and helping them feel confident choosing you for their care.
